Terms of Service

These Terms of Service ("Terms") govern your use of tinyworld.marutto.art (the "Service"). By accessing or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. The Service

The Service lets you place materials (terrain, buildings, plants, objects, characters, and more) in a diorama-style editor to build a "world," then save, share, and remix worlds posted by other users. Most materials available in the editor are generated using AI image-generation tools.

2. Free and Commercial Use of Materials

The individual materials provided in the editor (the tile and object images you place into your world) are free to use, including for commercial purposes, without attribution. This permission covers the materials themselves as provided by the Service. It does not cover the Service's software, source code, layout, branding, or the specific combination/arrangement of materials into a posted world work, which remain subject to these Terms and applicable law.

Some character materials are inspired by, or adapted with the help of AI from, characters that originate on marutto.art, restyled to match the visual style of this Service. These character materials are made available under the same free/commercial terms as other materials on this Service, for use within the scope described above.

3. AI-Generated Content

Because materials are produced using AI image-generation tools, they may occasionally contain artifacts, inconsistencies, or unintended similarities to existing works. We do not guarantee that any material is free of third-party rights, and we disclaim liability for such issues to the fullest extent permitted by law. If you believe a specific material infringes your rights, please contact us through our contact form and we will investigate.

4. Accounts

You may create an account with a login ID and password of your choosing, or by signing in with Google. You are responsible for keeping your credentials secure and for all activity under your account. We may suspend or terminate accounts that violate these Terms.

5. User-Posted Content

When you post a world, you retain ownership of your original arrangement and any original text you add (such as a title). You grant us a non-exclusive, worldwide, royalty-free license to host, display, and distribute your posted world as part of operating the Service, including allowing other users to view it and create "reMix" derivatives through the editor's normal functionality.

You must not post content that is illegal, infringes on the rights of others, or violates these Terms. We may remove content or restrict accounts at our discretion, without prior notice, if we believe this section has been violated.

6. Prohibited Uses

• Uploading or posting unlawful, infringing, defamatory, or harassing content
• Attempting to disrupt, overload, or gain unauthorized access to the Service
• Scraping or bulk-downloading the Service in a way that is not part of normal use
• Impersonating another person or misrepresenting your affiliation with anyone

7. Disclaimer of Warranties

The Service and all materials are provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to fitness for a particular purpose or non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or permanently available.

8. Limitation of Liability

To the fullest extent permitted by applicable law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the Service or reliance on materials obtained through it. Nothing in these Terms limits liability that cannot be excluded under Japanese law.

9. Changes to the Service and These Terms

We may modify or discontinue the Service, or update these Terms, at any time. Changes to these Terms will be posted on this page with an updated "Last updated" date. Continued use of the Service after a change constitutes acceptance of the revised Terms.

10. Governing Law

These Terms are governed by the laws of Japan, without regard to conflict-of-law principles. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts having jurisdiction over our principal place of business in Japan.
